2023 Earth Fest Hold Harmless Agreement for Electric Vehicle Participation

I have agreed to voluntarily take part in activities involving electric vehicles or electric bikes at Earth Fest. This includes being inside a vehicle/bike, riding a vehicle/bike, driving a vehicle/bike, operating a vehicle/bike or examining a vehicle/bike. This electric vehicle/bike may belong to me as an attendee at the event. If this is my vehicle, I am providing my own insurance to cover any accidents that may occur on or outside of the borough. This includes when I or any other attendee at the event performs any of the previously aforementioned actions such as driving, operating, examining, or being inside a vehicle when moving or parked. 

I understand that, as with driving or any activity, there is at least a possibility of an injury, accident or crash occurring. I am aware of such risks in the context of the aforementioned activities, and I have made the voluntary decision to engage in the activities and to agree in advance that I will not attempt to make any legal claim against the Borough of Ambler, its employees, Borough Council, or the Borough’s Environmental Advisory Council to recover any injury I might sustain, or any damage done to any vehicle, mine or other attendees, while participating in this program.  I understand that during the course of the day, I will not be considered an employee or contractor of Ambler.  

I understand that Ambler has made no determination of its own concerning my physical capability to perform the activities, or drive in any vehicle.  This is a decision I have made on my own.  If I have minor members of my family participating in the program, I will supervise their activities and I will sign on their behalf so that they are also holding the Borough harmless.  

If I require medical treatment, I understand that payment for same will be made by my insurance carrier or by me, personally.  I agree in advance to be transported to the nearest available hospital if I am injured and require emergency care.

I understand Vehicle participation is the sole discretion of the Ambler EAC. The Ambler EAC reserved the right to deny entry of any vehicle for any reason or if capacity has been reached in any way.
